Social Reintegration of Victims of Human Trafficking in Indonesia

Victims of trafficking in persons are understood as Victims of crime are persons who have suffered personal or collective harm, including physical or mental injury, mental suffering, financial loss, or substantial damage to their basic rights, as a result of acts or omissions that violate applicable criminal laws and laws. That prevents criminal abuse of power. Victims of human rights crimes, namely the right to obtain restitution, medical rehabilitation, social rehabilitation, social reintegration, and refoulment. This study uses normative legal research methods with a research approach, namely the statutory approach and the legal concept analysis approach. As well as the data analysis technique used is a qualitative descriptive analysis technique. the result of the social reintegration of victims of trafficking in persons as a process of reuniting victims with their families or communities includes physical, psychological and rehabilitation protection and ensures that the reintegration process of applicable social norms can be understood by victims who wish to return to their hometowns. In the Indonesian context, especially the Social Service in Malang, victims must also ensure that they have identity cards, family cards, and other supporting data as tools for identification and a complete assessment of human trafficking victims. However, considering that human trafficking victims are vulnerable, especially in population data and administration, other identification options are needed to make integrating human trafficking victims easier.

The Role of the Embun Pelangi Batam Foundation in Assistance to Victims of the Crime of Human Trafficking (TTPO)

This research analyzes the role of Yayasan Embun Pelangi in assisting victims of trafficking in persons (TTPO) as a response to the serious issue of human exploitation and trafficking in Indonesia. TTPO practices include human rights violations, including physical, sexual, and economic violence. The foundation provides assistance and protection through a mentoring program, aimed at the physical and emotional recovery of victims, as well as social reintegration. Holistic support includes counseling, psychological recovery, skills training, and legal awdvocacy. This research adopts a qualitative method with a literature review and semi-structured interviews, as well as Robert King Merton's theory of anomy, which describes the gap between social goals and the legitimate means of achieving them. This is influenced by social limitations that encourage individuals to achieve goals without legal channels.

Child Trafficking Offence: Case Study of Surabaya District Court Decision No. 685/PID.SUS/2022/PN SBY

The emergence of various forms of manipulation and exploitation has resulted in rampant trafficking in persons, in which children are also trafficked. Basically, children as the next generation of the nation have a role in ensuring the continuity of the nation. Therefore, children need to get ample opportunities to grow and develop. This study was conducted with the aim of describing how legal protection of children as victims of trafficking in persons. The research method used in this study is normative legal research which is studied using a statutory approach (statute approach). The results of this study show that children are very vulnerable to becoming victims of child trafficking for the purpose of exploitation. The law relating to child trafficking has been in force and has binding legal force, but its enforcement has not been sufficient to provide a deterrent effect for perpetrators. In this case, children as victims should get legal protection which includes protection of their dignity, dignity, and fulfillment of their rights. However, in the criminal justice system, victims are often given less attention, in reality Indonesian law only focuses on punishing perpetrators and overrides the rights and protection of victims.

The Crime of Trafficking in Persons with the Mode of Becoming a Female Worker

Law enforcement against the criminal act of trafficking in persons with the mode of becoming a female worker occurs very often in Indonesia so this research was carried out using an empirical juridical research method because this research aims to determine law enforcement for female victims of trafficking in persons. Obstacles in law enforcement against female workers show: 1) Law enforcement against perpetrators of the crime of trafficking in persons with victims of labor is in accordance with applicable law. Even though in law enforcement against perpetrators and victims who have reconciled, the legal process is not at the level of the prosecutor's office (prosecution process). 2) The police as a law enforcement agency in the process of enforcing the law on the criminal act of trafficking in persons also considers the value of justice

Rescuing victims of human trafficking: A case study in Vietnam

Although removing victims from trafficking occurs worldwide, little is known about how it works, particularly in developing Asian countries such as Vietnam. Appropriating Western strategies of victim removal is made more difficult in Vietnam given the country’s political ideology, top-down management, and centralised governance. To better understand and elucidate the process of TIP victim rescues, this paper used in-depth interviews with fifteen police officials, four officials of a non-governmental organization, and five victims of trafficking in persons (TIP) at a settlement in Vietnam. Findings demonstrated that state and non-state actors endeavoured to rescue victims. Depending on obligations, functions, and responsibilities, agencies were shown to implement separate campaigns, techniques, and operations to rescue trafficking victims. The study further explains the rationale for rescue and the difficulties faced by rescuers, particularly with respect to crossing the porous border between Vietnam and China. This research highlights practical insights for improving current policies, legal framework, programs, and strategies to effectively rescue TIP victims.

Research Methods The author uses a normative juridical method because the target of this research is law and norms. The definition of rules includes, legal principles, rules in the narrow sense and concrete legal regulations. This normative juridical research method aims to find coherent truths through deductive ways of thinking. The deductive way of thinking means that the research will depart from a specific idea. Research Results Legal protection for victims of the crime of trafficking in persons can not only be realized in the form of punishment of the perpetrators, but also in the form of fulfilling rights, including the right to obtain confidentiality of identity, the right to to obtain restitution or compensation, as well as the right to obtain .1. Declare that the Defendant HANITA SARI NASUTION ALS NONA has been legally and convincingly proven guilty of committing the crime of “Trafficking in Persons”; 2. Sentenced punishment on the Defendant therefore with imprisonment for 4 (four) years and a fine of Rp. 120,000,000.00 (one hundred and twenty million rupiahs) provided that if the fine is not paid, it is replaced with imprisonment for 3 (three) months.. The government's efforts or solutions to overcome human trafficking are as follows. The government strengthened security at the border. The government is strengthening laws and enforcement on human trafficking. The government cooperates with other countries, especially in the investigation and prosecution of perpetrators of human trafficking.

Legal Protection for Victims of Trafficking in Persons From a Human Rights Perspective

This study aims to determine the legal protection for victims of trafficking in persons in terms of human rights perspective. This research is based on the fact that there are still cases of trafficking in persons and the protection of victims is still not effective. Victims are entitled to protection according to human rights guidelines. The author conducted this research using a normative research method using a statutory approach related to the object under study and also using a conceptual approach. The data collection technique used is secondary data consisting of primary legal materials, namely legislation and secondary legal materials in the form of books, scientific papers and data obtained. This study explains that a person who is a victim of trafficking in persons is entitled to protection in accordance with the provisions of the legislation as well as the provision of compensation rights to victims of trafficking in persons according to the human rights inherent in him. And this study also discusses the role of the government and the community in an effort to provide protection for victims of trafficking in persons to uphold human rights.

Juridical Review of the Right to Restitution, Rehabilitation, and Compensation for Victims of the Crime of Trafficking in Persons according to Law No. 21 of 2007 on Court Decisions

The two continents and oceans around Indonesia make Indonesia in the position of international shipping trade routes. However, in the geographical location of the State of Indonesia, it is threatened to become a traffic lane for crime. Trafficking in people or persons is not only a domestic concern, but is a universal problem that is increasing every year. The purpose of this research is to find out or provide knowledge about the fulfillment of restitution rights and rehabilitation rights, and compensation for victims of trafficking in persons which are criminal acts in court decisions. Normative juridical law is the method used by the author in this study. This study provides results that the right to rehabilitation, restitution, and compensation for victims of the Criminal Act of Trafficking in Persons in Decision No. 257/Pid.Sus./2019/PN SDA and Decision No. 889/Pid.Sus/2018/PN SDA according to the Law No. 21 of 2007 was not implemented or not applied by the Panel of Judges.

LEGAL PROTECTION OF VICTIMS OF TRAFFICKING IN PERSONS IN INDONESIA (A REALITY IN EAST INDONESIA)

Trafficking in persons is an act that is inhumane and is a serious problem that must be resolved immediately. Indonesia is no longer a transit country but has also become a destination country for shipments and a sending country for victims of trafficking in persons. The mode that can occur in cases of trafficking in persons is through the Indonesian Migrant Workers mode. A person who is a victim of trafficking in persons is usually lured into working abroad with a large income. Trafficking in persons is a form of transnational crime, where there is usually involvement of people abroad and activities that occur across national borders. This research is a qualitative research with the research locus in Kupang, East Nusa Tenggara and also in Jakarta. The purpose of this study is to find out how the process of sending victims of trafficking in persons and the reasons a person becomes a victim of trafficking in persons, and how the law is implemented in Indonesia.

Prostitution and the Victims Protection: The Discourse of Law Enforcement and Legal Protection (Case of Cianjur, Indonesia)

This study aims to analyze how the law is enforced for victims of trafficking in persons used as perpetrators of prostitution in the Cianjur Regency. The method used in this research is using a qualitative method with a descriptive-analytic approach. The source of data in this study is using the interview instrument. The research object is focused on Cianjur Regency, which is divided into Sukanagara District, Cianjur District, Cipanas District, and several commercial places such as tourist attractions, entertainment venues, universities, and high schools in the Cianjur Regency area. This article concludes that various reasons and social conditions encourage the increasing number of prostitution in the Cianjur Regency area. Different unique findings were found in the research process. First, a high-paying job offer mode is quite successful in attracting certain regions. Second, sexual harassment issues made some teenagers decide to go deeper into the prostitution circle. Third, the number of foreign tourists from certain countries is the main attraction in the increasing cases of prostitution in one of the research object areas. The increase in cases of prostitution that continues to grow requires special attention from various parties, especially in the eyes of the law for the perpetrators. As time goes by, prostitution cases that continue to be left unchecked will become a significant factor in the deteriorating morals and social values ​​that exist in society. The absence of a clear legal status for prostitution will increasingly make the perpetrators freely carry out their crimes

Legal Protection of Women as Victims of Trafficking under the Provisions of Law No. 12 of 2017

Asean Convention Against Trafficking In Persons, Especially Women and Children is a convention that has been ratified in Indonesia into Law Number 12 of 2017 containing opposition to trafficking in persons, especially women and children and an important role and duties of the state in order to fight against trafficking in persons. The protection of women as a victim of trafficking in persons is contained in Article 14 which contains 14 points of tasks that must be carried out by the state in protecting victims of trafficking in persons. Prevention of trafficking in persons that must be carried out by the state is contained in Article 11 which contains 5 points of preventive measures. The fact that happened in Indonesia, this regulation has not been realized and the benefits have not been felt by the peoples especially women who have been involved and being victims of trafficking in persons. New regulations that are in line with international law and protect the vistims have not been made as a follow-up to this convention, and implementation and monitoring are still at a low level

Point of this study is as follows: (a) What are the legal rules for the protection of children as victims of trafficking in persons, (b) What are the factors causing the crime of trafficking in women and children in North Sumatra, (c) What are the policies carried out by the women's empowerment office? and children in North Sumatra in preventing and overcoming traffickers against children. The type of research in this writing is normative legal research. Normative or doctrinal legal research, namely legal research that uses secondary data source research. The results of the research and discussion in this study are: The Legal Rules for the Protection of Children as Victims of Trafficking in Persons are as follows: (a) Law Number 23 of 2002 concerning Child Protection; (b) Law of the Republic of Indonesia Number 21 of 2007 concerning Eradication of the Crime of Trafficking in Persons; (c) Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002 concerning Child Protection; (d) North Sumatra Province Regional Regulation Number 3 of 2014 concerning the Implementation of Child Protection. Factors Causing the Crime of Trafficking in Women and Children in North Sumatra: Several factors that cause child trafficking include the following: (a) Poverty; (b) Low Education Level; (c) Victims of Parental Divorce; (d) Early Sexual Experience; (e) Job Seekers. Policies in overcoming criminal acts of protecting people are carried out in three ways, namely: (a) Primary Prevention, (b) Secondary Prevention, (c) Tertiary Prevention.

Penanggulangan Orang Asing Yang Menjadi Korban Perdagangan Orang dan Penyeludupan Manusia di Bidang Keimigrasian

Indonesia is a country that attracts the attention of foreigners to visit Indonesia. The number of foreign enthusiasts to visit the territory of Indonesia makes immigration a gateway for a country that is very picky in allowing foreigners to enter Indonesia. procedures that are deemed too difficult, individuals appear who can make it easier for foreigners to enter Indonesian territory. because of this, many people take advantage of it to gain profits by committing crimes in the form of human trafficking and people smuggling. This study describes the handling of foreigners who are victims of human trafficking and people smuggling in accordance with existing laws and regulations. In addition, the implementation of statutory regulations in terms of handling foreigners who become victims of trafficking in persons and people smuggling has been carried out by the Immigration Office in the form of placing foreigners in the Immigration Detention Center or other designated places without being subject to Immigration Administrative Actions and also different handling with detainees for other cases, as well as managing files and data from victims of trafficking in persons and people smuggling so that they can be immediately repatriated to their countries of origin. In repatriating victims to their countries of origin, immigration cooperates with the ministry of foreign affairs to coordinate with state representatives in Indonesia.

Human Trafficking in Woman and Children Perspective; Protocol to Prevent, Suppress and Punish in Persons

Trafficking in persons is a cross-border crime which injures human dignity. The mode of trafficking in persons is to take advantage of the economic conditions of potential victims by luring them a better job. This research will discuss the profile of victims of trafficking in persons, gender analysis in human trafficking, and international policies in victim protection that are gender equality oriented. This research is a normative juridical study examining the analysis of international legal instruments, laws and court decisions. The research was conducted using the statute approach, legal concepts and the concept of gender. The victims of trafficking in persons are dominated by women, although it does not rule out the possibility that men can also be the victims. Women are considered as commodities that can provide benefits because they can be bought and sold to do work without requiring high education, and even provide sexual services. The perpetrators of the criminal network carry out the recruitment of potential victims by involving the householder of the potential victim, in this case the husband or father of the potential victim. This condition cannot be separated from the deep rooted patriarchal culture in the society, in which the men play a role as the decision makers in the family. Power relations play an important role in analyzing this crime of trafficking in persons. Efforts to combat trafficking in persons are carried out within the framework of a gender-equitable policy. However, the existing legal instruments have not addressed the fundamental problems of trafficking in women. Reconstruction of the legal culture of society is very important in protecting women from various forms of violence.

The crime of trafficking in persons often occurs among women and children. This case is mostly among adult women; this is due to demands (less economic) so that trafficking in persons often occurs. The government must eradicate this case and provide legal protection for victims of trafficking in persons so that women and children are not arbitrarily treated by traffickers. The type of research used is juridical normative; a study the discussion of which is based on laws and legal materials. The results of the analysis show that the criminal sanctions given to the perpetrators must be really sanctions that give a deterrent effect, so that the perpetrators do not repeat their mistakes. In addition, the existence of sanctions can reduce criminal cases of trafficking in persons against women and children, and no one treats women and children arbitrarily, and no longer makes women and children victims of trafficking in persons. So that children and women can become the next generation of the nation to be proud of themselves and others.

Sosialisasi dan Penyuluhan Undang-Undang Nomor 21 Tahun 2007 Tentang Pemberantasan Tindak Pidana Perdagangan Orang di Desa Lebak Kepuh Kecamatan Lebak Wangi sebagai Kantung Tenaga Kerja Wanita di Kabupaten Serang

Becoming a female worker abroad, especially in Middle Eastern countries, Malaysia is the dream and hope for most women and families in Lebak Kepuh Village. Family poverty factor is the main reason for families to send their children to work abroad. Working as farm laborers and getting caught up in loan sharks forced these families to send their children to become TKW. Private Indonesian Employment Service Delivery Companies (PPTKIS) have sprung up as a connector between workers and overseas job providers. However, unfortunately, many of these PPTKIS are not registered with the Ministry of Manpower and some are looking to the villages to seduce women to be sent to work abroad or in the capital city with the lure of a large salary. Even though this is often not true. Instead of getting a job, they are even traded in the trafficking of people into commercial sex workers and / or into illegal labor. This activity aims to socialize Law Number 21 of 2017 concerning the Eradication of the Crime of Trafficking in Persons. The causes, methods, methods and consequences of victims of trafficking in persons are presented and described in this activity. This includes serious legal sanctions that will be imposed on parties who deliberately commit the criminal act of trafficking in persons. Collaboration of Resources in Task Force for Prevention and Handling Victims of Human Trafficking in Indonesia

The purpose of this study is to examine the cause of the ineffectiveness of resource collaboration in preventing and handling trafficking victims in West Java Province. This research method is a qualitative study that focuses on human and social problems through primary and secondary data collection. The results of this study indicate that the collaboration of resources in the prevention and handling of victims of trafficking in persons in West Java Province has not been effective. It triggered by the leading sector, problems of coordination of sharing resources, overlapping problems, roles, and resources, political factors, constraints of responsiveness of policymakers, and administrative issues.

The research method used by the writer is descriptive research type with a normative legal approach. The results showed that children and women were the most victimized, because they were often the targets and were considered the most vulnerable. The aim of this research is that the state will protect child victims of trafficking in persons from the perpetrators of these evil acts in accordance with Law Number 35 of 2014 concerning amendments to Law Number 23 of 2002 concerning Child Protection.Keywords: legal protection, child, victims, trafficking
